Please read these Terms and Conditions carefully before using the HungerFresh mobile application ("App") and its related services ("Services"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
HungerFresh operates as a technology platform that connects users with independent third-party restaurants, merchants, and independent delivery service providers ("Delivery Partners") to facilitate the ordering, sale, and delivery of food and grocery products.
1.1. Our Role: HungerFresh is an intermediary. We do not prepare the food or sell the groceries. The contract for the sale of Food or Grocery items is strictly between you and the respective Restaurant/Merchant. The contract for delivery is between you and the Delivery Partner. We are not responsible for the acts or omissions of the Merchants or Delivery Partners.
1.2. Merchant/Restaurant Responsibility: Merchants are solely responsible for compliance with all applicable laws, including but not limited to food safety, preparation, quality, and hygiene standards. We do not independently verify the claims made by Merchants (e.g., regarding ingredients, allergens, or dietary restrictions).
2.1. Eligibility: You must be at least 18 years old and competent to contract to use the Services. If you are under 18, you may use the Services only under the supervision of a parent or legal guardian.
2.2. Account: You must register and maintain an active user account to use the Services. You agree to provide accurate, complete, and current information during the registration process and to maintain the confidentiality of your account credentials. You are responsible for all activity that occurs under your Account. You are permitted to have only one HungerFresh account.
3.1. Ordering: Placing an order through the App constitutes an irrevocable instruction to purchase the item(s) from the Merchant and/or engage a Delivery Partner on your behalf. All orders are subject to acceptance and availability by the Merchant/Restaurant.
3.2. Pricing: All prices are listed by the Merchants/Vendors. While we make every effort to ensure correct pricing, errors may occur. If the correct price is higher than the price stated on the App, we will generally contact you for instructions before dispatching the order.
3.3. Payment: You agree to pay all fees and charges incurred in connection with your order, including the purchase price of the items, taxes, delivery fees, and any applicable service fees. We accept various payment methods. You warrant that you are the lawful owner of the payment method used.
3.4. Failed Delivery: If an order cannot be delivered due to your fault (e.g., wrong address, failure to accept the delivery, or unavailability to receive the delivery), the order will be canceled, and you may be charged the full amount of the order and the delivery fee.
4.1. Customer Cancellation: You may cancel an order only if the cancellation option is available in the App and before the Merchant/Restaurant has started preparing the order (for food) or the Merchant has packed the items (for groceries). The App will indicate the cut-off time. Cancellations made after this time may incur a full charge for the order.
4.2. Merchant/App Cancellation: The Merchant or HungerFresh may cancel an order due to item unavailability, delivery location limitations, fraudulent transactions, or other reasons. If an order is canceled by the Merchant or the App after payment, a full refund will be processed.
4.3. Refunds: Refunds for canceled or incorrectly delivered items will be processed according to our separate Cancellation & Refund Policy (to be linked). Refunds will typically be credited back to the original payment method within [Number] business days.
You agree not to use the App for any unlawful purpose or in any way that violates these Terms, including:
Submitting false, misleading, or fraudulent information.
Reselling any items purchased through the App.
Interfering with the operation of the App or the integrity of any content or data.
Harassing or abusing our Delivery Partners or customer service staff.
The HungerFresh name, logo, design, and all content on the App (excluding Merchant-provided content) are the property of HungerFresh and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial use only.
To the maximum extent permitted by law, HungerFresh, its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:
Your use or inability to use the Service.
Any conduct or content of any third party (including Merchants and Delivery Partners).
Errors or omissions in the content of the App.
You agree to indemnify and hold harmless HungerFresh, its officers, directors, employees, and agents from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of the Services; (ii) your breach or violation of any of these Terms; (iii) your violation of the rights of any third party, including Merchants and Delivery Partners.
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction/Country], without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by the courts located in [Your City/Region].
