HungerFresh Terms and Conditions ("Terms of Use")

Please read these Terms and Conditions carefully before using the HungerFresh mobile application (“App”) and its related services (“Services”). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Services.

1. The Service

HungerFresh operates as a technology platform that connects users with independent third-party restaurants, merchants, and delivery service providers (“Delivery Partners”) to facilitate the ordering, sale, and delivery of food and grocery products.

1.1 Our Role

HungerFresh acts solely as an intermediary platform. We do not prepare food, manufacture products, or directly sell grocery items.

  • The contract for the sale and purchase of food or grocery products is strictly between the customer and the respective restaurant or merchant.
  • The contract for delivery services is between the customer and the Delivery Partner.

1.2 Merchant / Restaurant Responsibility

Restaurants and merchants are solely responsible for compliance with all applicable laws, including:

  • Food safety regulations
  • Hygiene standards
  • Packaging requirements
  • Preparation quality
  • Ingredient disclosure
  • FSSAI licensing
  • GST compliance

HungerFresh does not independently verify merchant claims regarding:

  • Ingredients
  • Allergens
  • Nutritional values
  • Dietary suitability

HungerFresh shall not be liable for any:

  • Food-related illness
  • Allergic reaction
  • Contamination
  • Health issue
  • Damage arising from products supplied by merchants

Customers are advised to verify allergen and ingredient information directly with the merchant before placing an order.

1.3 Delivery Timelines

Delivery times shown on the App are estimates only and may vary due to:

  • Traffic conditions
  • Weather
  • Merchant preparation delays
  • Festivals
  • Strikes
  • High-demand periods
  • Unforeseen circumstances

HungerFresh does not guarantee exact delivery times.

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Services. Users below 18 years may use the App only under the supervision of a parent or legal guardian.

2.2 Account Registration

To access the Services, you must create and maintain an active user account.

You agree to:

  • Provide accurate and updated information
  • Maintain confidentiality of your login credentials
  • Take responsibility for all activities under your account

Only one account per user is permitted unless otherwise approved by HungerFresh.

2.3 Account Suspension

HungerFresh reserves the right to suspend or permanently terminate accounts involved in:

  • Fraudulent activity
  • Fake orders
  • Repeated cancellations
  • Abuse of promotional offers
  • Harassment
  • Fake reviews
  • Platform misuse
  • Violation of these Terms

3. Orders, Pricing, and Payment

3.1 Ordering

Placing an order through the App constitutes an irrevocable instruction to purchase items from the selected merchant and/or engage a Delivery Partner on your behalf.

All orders are subject to acceptance and availability.

3.2 Pricing

Prices displayed on the App are determined by merchants and may change without prior notice.

While HungerFresh attempts to maintain accurate pricing, errors may occasionally occur. If the actual price differs from the displayed price, we may contact you before processing the order.

3.3 Payment

You agree to pay all applicable charges including:

  • Product price
  • Taxes
  • Delivery fees
  • Packaging charges
  • Platform fees
  • Service charges

HungerFresh may support:

  • Online payments
  • UPI
  • Debit/Credit Cards
  • Wallet payments
  • Cash on Delivery (“COD”)

You confirm that you are legally authorized to use the selected payment method.

3.4 Failed Delivery

If delivery cannot be completed due to customer fault, including:

  • Incorrect address
  • Unreachable phone number
  • Refusal to accept delivery
  • Customer unavailability

The order may be cancelled and full charges may still apply.

3.5 Wallet, Cashback & Reward Points

HungerFresh may provide:

  • Cashback
  • Reward points
  • Referral credits
  • Wallet balances
  • Promotional offers

These benefits are:

  • Non-transferable
  • Non-refundable
  • Not redeemable for cash

HungerFresh reserves the right to modify or discontinue such programs without prior notice.

3.6 Cash on Delivery Restrictions

HungerFresh reserves the right to disable COD services for users involved in:

  • Repeated order rejections
  • Frequent cancellations
  • Refund abuse
  • Suspicious activities

4. Cancellation and Refunds

4.1 Customer Cancellation

Orders may only be cancelled before the merchant begins preparation or packing.

Once preparation has started:

  • Cancellation may not be permitted
  • Full charges may apply

4.2 Merchant or Platform Cancellation

HungerFresh or the merchant may cancel orders due to:

  • Product unavailability
  • Operational issues
  • Delivery limitations
  • Pricing errors
  • Suspected fraud
  • Unforeseen circumstances

Eligible refunds will be processed accordingly.

4.3 Refund Processing

Approved refunds are generally credited back to the original payment method within 5–7 business days, depending on banking or payment gateway timelines.

4.4 Non-Refundable Situations

Refunds may not be applicable in cases including but not limited to:

  • Incorrect delivery details
  • Customer unavailable at delivery location
  • Refusal to accept delivery
  • Minor packaging variations
  • Traffic or weather-related delays
  • Dissatisfaction with taste preferences

5. User Conduct and Restrictions

You agree not to:

  • Submit false or misleading information
  • Abuse promotional offers
  • Harass delivery partners or support staff
  • Use the App for unlawful activities
  • Resell products purchased through the App
  • Attempt unauthorized access to the platform
  • Interfere with App security or operations
  • Use bots, scraping, reverse engineering, or unauthorized copying

6. Intellectual Property

The HungerFresh name, logo, application design, software, trademarks, and content (excluding merchant-provided content) are the intellectual property of HungerFresh and protected by applicable laws.

Users are granted a limited, non-exclusive, non-transferable license to use the App for personal and non-commercial purposes only.

7. Privacy Policy

Your use of the App is also governed by the HungerFresh Privacy Policy, which explains how user data is collected, stored, used, and protected.

8. Limitation of Liability

To the maximum extent permitted by law, HungerFresh, its affiliates, employees, directors, agents, and partners shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Service interruptions
  • Delivery delays
  • Merchant disputes
  • Food quality issues
  • App errors or omissions

In no event shall HungerFresh’s total liability exceed the amount paid by the customer for the specific order giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless HungerFresh and its affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Services
  • Violation of these Terms
  • Violation of applicable laws
  • Infringement of third-party rights

10. Force Majeure

HungerFresh shall not be liable for any failure or delay caused by events beyond reasonable control, including:

  • Natural disasters
  • Floods
  • Pandemics
  • Internet outages
  • Strikes
  • Riots
  • Government restrictions
  • Technical failures
  • Power interruptions

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India.

Any disputes arising from these Terms or the Services shall fall under the exclusive jurisdiction of the courts located in:

Hyderabad, Telangana, India

12. Changes to Terms

HungerFresh reserves the right to modify or update these Terms at any time.

Material changes will be notified through the App or website at least 7 days before becoming effective.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
